1. Description of Services

BhasaLearn provides the following Services:

• BhasaLearn Platform: Interactive Nepali and Nepal Bhasa (Newari) language learning lessons, including grammar, typing, literature, and Chhanda (poetry metre). The platform includes gamified features such as streaks, XP, and leaderboards.
• IRIS AI Workspace:An AI-powered study workspace that helps students generate study sets, flashcards, mind maps, quizzes, and practice exam papers from their course materials. IRIS AI is designed for Nepal's SEE, BLE, and NEB curriculum but supports any subject.

Both services are currently offered in a Free Beta period. Features and availability may change without notice during the beta period.

2. Accounts & Eligibility

To access certain features (including IRIS AI and progress tracking), you must create an account. When creating an account:

• You must provide accurate and complete information.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 13 years of age. Users under 18 should have parental or guardian consent.
• You may not share your account with others or create accounts on behalf of others without authorisation.
• You are responsible for all activities that occur under your account.

We use Google OAuth and Supabase for secure authentication. We do not store passwords directly.

3. Acceptable Use

You agree to use BhasaLearn only for lawful purposes and in accordance with these Terms. You must not:

• Use the Services to harass, abuse, threaten, or harm any person.
• Upload, submit, or share content that is illegal, obscene, defamatory, or infringes on intellectual property rights.
• Attempt to gain unauthorised access to any part of our platform, servers, or databases.
• Use automated bots, scrapers, or other tools to extract data from our platform without prior written permission.
• Attempt to reverse-engineer, decompile, or copy proprietary aspects of our Services.
• Use IRIS AI to generate academic work and submit it as your own in academic institutions where AI assistance is prohibited (you are responsible for compliance with your institution's academic integrity policies).
• Interfere with, disrupt, or overburden our infrastructure.
• Upload malware, viruses, or harmful code.

Violation of these rules may result in immediate suspension or termination of your account.

4. AI-Generated Content Disclaimer

IRIS AI generates content using large language models (including Google Gemini). AI-generated content may occasionally be inaccurate, incomplete, or misleading. Please note:

• AI content is not a substitute for professional advice. Do not rely solely on AI-generated content for medical, legal, financial, or other professional decisions.
• Verify important information. Always cross-check AI-generated study material with authoritative sources, especially for exam preparation.
• Academic integrity.You are responsible for ensuring your use of AI-generated content complies with your school, university, or institution's academic integrity policies.
• BhasaLearn is not liable for academic, professional, or other consequences arising from your reliance on AI-generated content.

5. Intellectual Property

All content on BhasaLearn — including lesson text, curriculum data, design, graphics, software code, the IRIS AI system, and the BhasaLearn name and logo — is the intellectual property of BhasaLearn and its licensors. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

The BhasaLearn curriculum content, including Nepali and Nepal Bhasa lesson materials, is original work or appropriately licensed educational content. Official government textbook content (CDC textbooks) referenced in IRIS AI remains the property of the Government of Nepal's Curriculum Development Centre.

6. User Content

When you upload documents, paste text, or create notebooks in IRIS AI, you retain ownership of your content. By uploading content to our Services, you grant us a limited, non-exclusive licence to process that content solely for the purpose of providing you with the requested AI-generated output.

You represent and warrant that you have the right to upload any content you submit and that it does not infringe the intellectual property rights of any third party.

We do not use your uploaded documents or personal data to train our AI models without your explicit consent.

7. Free Beta & Future Pricing

BhasaLearn and IRIS AI are currently provided free of charge during our beta period. We may introduce paid plans in the future. If we do:

• We will provide reasonable advance notice before any free features become paid.
• Any core language learning lessons that are currently free will remain accessible at no cost or at an affordable price point.
• Pricing will be clearly communicated on our Pricing page before any charges apply.

Google AdSense ads may be displayed within the platform as part of our free tier. By using our Services, you acknowledge and accept the display of advertisements.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, or for any other reason at our discretion, with or without notice. Upon termination:

• Your right to use the Services will immediately cease.
• Your account data may be deleted in accordance with our Privacy Policy.
• Provisions of these Terms that by their nature should survive termination will remain in effect.

You may also delete your account at any time by contacting us at support@bhasalearn.com.

9. Disclaimers & Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by applicable law, BhasaLearn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services — including but not limited to loss of data, loss of learning progress, or harm caused by reliance on AI-generated content.

Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim (or NPR 0 if no payment was made).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Nepal.

If you are accessing our Services from outside Nepal, you are responsible for compliance with your local laws.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the “Effective Date” at the top of this page. For significant changes, we will provide notice via email or in-app notification. Your continued use of the Services after any change constitutes your acceptance of the new Terms.
